1. ABOUT THESE TERMS

Welcome to Pressona. These Terms of Service (“Terms”) govern your use of pressonanails.com (the “Website”) and purchases made through the Website.

The Website is operated by Pressona & Co. Inc, a company organized under the laws of California, doing business as Pressona (“Pressona,” “we,” “us,” or “our”). Our online store is hosted on Shopify, which provides the platform we use to offer our products.

Please read these Terms before placing an order. Any purchase-specific policies and promotion terms expressly presented to you also apply to the relevant purchase. Our Privacy Policy separately explains how we handle personal information.

Nothing in these Terms excludes or limits consumer rights that cannot lawfully be excluded or limited.

2. ELIGIBILITY AND ACCOUNTS

Our products are intended for individuals aged 16 and older.

To place an order, you must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction. If you are aged 16 or 17, a parent or legal guardian must place the order on your behalf.

You agree to provide accurate and current contact, billing, and shipping information. If you create an account, you are responsible for keeping your login information secure and notifying us promptly of any suspected unauthorized use.

3. OUR PRODUCTS

Pressona offers press-on nails and related application accessories. Please review the applicable product description, sizing information, package contents, and instructions before purchasing.

Handcrafted products may have minor variations in shape, finish, color, or decorative details. Product appearance may also vary with lighting, screen settings, and the natural nail beneath a translucent design. These variations do not excuse a product that is defective, materially different from its description, or otherwise fails to meet applicable legal requirements.

Fit, wear time, and reusability may vary depending on nail shape, sizing, preparation, application, removal, and everyday activities. Unless expressly stated in a product description, we do not promise a particular wear duration or an identical result for every customer.

4. PRODUCT USE AND SAFETY

Each nail set includes adhesive tabs and alcohol prep pads. Ingredient information is provided on the applicable packaging.

Read and follow all instructions, ingredient information, and warnings before use. If you have questions about ingredients before purchasing, contact us at sales@pressonanails.com.

Use products only for their intended purpose. Do not apply them to damaged or irritated nails or skin. Stop using a product if irritation or another adverse reaction occurs, and seek appropriate medical advice when needed. Keep products and application accessories away from children and follow all applicable storage and disposal instructions.

Our products and Website content are intended for cosmetic use and general product information, not for diagnosing or treating medical conditions.

These precautions do not limit our responsibility for defective or unsafe products where applicable law imposes that responsibility.

5. ORDERS AND PAYMENT

Please review your order carefully before submitting it. You confirm that you are authorized to use the payment method provided.

An order confirmation acknowledges receipt of your order; it does not by itself confirm acceptance. We accept your order when we send a shipping confirmation, unless we expressly notify you of acceptance earlier.

Before acceptance, we may decline or cancel an order for a reasonable cause, including unavailable inventory, a material pricing or listing error, payment authorization failure, suspected fraud, or a legal restriction. We will notify you if we cancel your order and refund any payment collected for the canceled items.

If a material error affects your order, we will not charge a higher price without your agreement. You may choose whether to proceed on the corrected terms or receive a refund for the affected items.

Customer requests to change or cancel an order are subject to applicable law and any cancellation policy disclosed before purchase.

6. PRICES, TAXES, AND INTERNATIONAL CHARGES

Prices are shown in the currency indicated on the Website or at checkout. Prices and promotions may change for future purchases; those changes do not alter an order we have already accepted.

Applicable taxes and shipping charges will be shown or included as required by law before you complete your purchase. We collect sales tax and other transaction taxes where we are required to do so.

For international orders, any applicable arrangement for import duties, import taxes, and carrier clearance charges must be disclosed before purchase. Nothing in these Terms alone makes you responsible for charges that we are legally required to bear.

Your bank or payment provider may separately charge currency conversion or international transaction fees under its agreement with you.

7. SHIPPING, RETURNS, EXCHANGES, AND CANCELLATIONS

Orders are dispatched from California, United States.

Order processing, delivery, cancellation, return, and exchange arrangements are governed by applicable law and the policies expressly disclosed to you before purchase. Please contact us if you need assistance with a damaged, incorrect, or missing order.

Nothing in these Terms restricts remedies available under mandatory consumer protection laws.

8. LAUNCH GIFT AND OTHER PROMOTIONS

Our launch offer provides one complimentary press-on gift set with each of the first 2,000 paid orders placed through the Website.

The promotional gift is a single designated style selected by Pressona. Customers cannot select or exchange the gift for a different style. The gift has no cash redemption value. This does not affect remedies for a defective gift required by law.

Any conditions relating to the gift following an order cancellation, return, or refund must be disclosed before purchase and remain subject to applicable law.

Other promotions may have separate eligibility requirements, dates, or conditions displayed with the offer. We will honor the applicable terms of an accepted order and will not retrospectively remove an earned promotional benefit except where permitted by law, including in cases of fraud.

9. CUSTOMER REVIEWS AND PHOTOGRAPHS

We welcome honest reviews, including critical or negative feedback.

You retain ownership of the reviews you submit. By submitting a written review for publication on the Website, you grant us a nonexclusive, royalty-free license to display that review and the display name you choose, and to make technical formatting changes necessary to present it. We will not change the substance of your review or use this permission to imply a different opinion.

Reviews must reflect genuine experiences and must not contain spam, unlawful material, another person’s private information, or content that infringes another person’s rights. We may moderate content on these grounds, but we will not remove or suppress a review simply because it is negative.

Submitting a photograph or video to customer service does not give us permission to publish it. Before using customer photographs or videos on our Website, social media, or in advertising, we will request and obtain separate written permission identifying the intended use. Sending us an image or tagging our brand does not, by itself, provide that permission.

10. INTELLECTUAL PROPERTY

The Website’s original text, photographs, graphics, branding, and other content are owned by Pressona or used with permission and are protected by applicable intellectual property laws.

You may browse the Website and use its content for personal shopping purposes. Except as permitted by law or with our written permission, you may not reproduce, distribute, modify, or commercially exploit our protected content.

Nothing in these Terms restricts lawful commentary, honest reviews, or uses otherwise permitted by applicable law.

11. ACCEPTABLE USE

You must not use the Website to engage in fraud, misuse another person’s identity or payment information, introduce malicious software, obtain unauthorized access, or materially interfere with the Website’s operation.

We may restrict access where reasonably necessary to address unlawful conduct, a security risk, or a material breach of these Terms. Any restriction does not remove your rights relating to orders already paid for.

12. THIRD-PARTY SERVICES AND PRIVACY

The Website may use or link to third-party services, including payment providers. Their services may be subject to separate terms and privacy policies.

Our Privacy Policy explains how we collect and use personal information. Agreement to these Terms does not, by itself, constitute consent to receive marketing emails or text messages.

The use of third-party providers does not exclude responsibilities that we retain under applicable law.

13. WEBSITE AVAILABILITY AND LIABILITY

We take reasonable care in operating the Website, but we do not guarantee that access will always be uninterrupted or free from technical errors. We may temporarily suspend access for maintenance or security reasons.

To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from your use of the Website or purchase of our products.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury or death caused by negligence, or any product liability, warranty, consumer remedy, or other responsibility that cannot lawfully be excluded or limited.

Any limitation applies only to the extent permitted in your jurisdiction.

14. GOVERNING LAW AND DISPUTES

These Terms are governed by California law and applicable United States federal law, without depriving you of mandatory consumer protections that apply in your place of residence.

If you have a concern, please contact sales@pressonanails.com so we can try to resolve it. Contacting us is encouraged but does not prevent you from exercising a legal right, meeting a filing deadline, or contacting a regulator.

Any court proceeding will be subject to applicable jurisdiction and venue rules. These Terms do not require mandatory arbitration or waive your right to bring a claim in a court that has jurisdiction.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time. The revised version and its effective date will be posted on the Website, and we will provide additional notice of material changes where required by law.

Updated Terms will apply prospectively. Unless required by law or separately agreed with you, changes will not alter an existing order or a dispute that arose before the changes took effect.

16. GENERAL

If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

These Terms and the purchase policies expressly incorporated into them govern the matters they address, subject to applicable law and any specific commitments we make to you concerning your order.
